Loewe Terms and Conditions – Participate in the Raffle and Win Exclusive Prizes

1. Subject

1) These terms and conditions and data protection notices govern participation in the Loewe raffle as part of the “Win Exclusive Prizes with Loewe” campaign by Loewe Technology GmbH. The organiser of the raffle is Loewe Technology GmbH, Industriestraße 11, 96317 Kronach, [email protected] (hereinafter referred to as the “Organiser”). Participation in the raffle is exclusively subject to the conditions outlined herein. Participation is made by registering a completed purchase of any Loewe product via the URL: https://www.loewe.tv/kylian-jersey-raffle, which must have been purchased either from an official Loewe authorised dealer or from the Loewe online shop on the Loewe website www.loewe.tv, within the raffle period specified herein. Registration requires providing your first name, last name, email address, shop details, and the purchased product in order to participate in the raffle. Personal data will be used and stored solely for the purpose of conducting and processing this raffle. Loewe reserves the right to request proof of payment or an invoice from participants to verify eligibility. 

2) By participating in the raffle, you accept these terms and conditions of the Organiser, as of November 2024. This acceptance is confirmed by actively clicking and checking the designated checkbox in the raffle registration form to confirm these terms and conditions and data protection notices, and by providing the detailed purchase information described herein. 

 

2. Connection to Facebook/Instagram for Promotion

1) In addition to these terms and conditions, the relationship between the Organiser, the participant, and Facebook/Instagram is not affected by these terms. 

2) Even if the raffle is promoted on Facebook or Instagram, the Organiser expressly states that neither the raffle application nor the raffle itself is in any way sponsored, supported, or organised by Facebook/Instagram, nor is it associated with Facebook/Instagram. The sole contact and responsible party is the Organiser. 

3) All information and data shared through the raffle application or during the raffle by participants will be provided solely to the Organiser and its commissioned service providers, and not to Facebook/Instagram. 

 

3. Procedure, Prizes, Eligibility, and Winning

1) The raffle begins on 25 November 2024 and ends on 31 December 2024 at 23:59:59 CET. Only participants who actively take part in the raffle within this exact period will be entered into the draw. 

2) Eligible participants are all individuals who are 18 years or older, have made a purchase of a Loewe product during the raffle period from an official Loewe retailer or on the Loewe website, have not withdrawn the purchase, have agreed to the terms and conditions, and have completed and submitted the raffle registration form within the raffle period. Only participants who provide accurate details (valid and correct email address) and optionally additional, voluntary information in the raffle registration form during the raffle period are eligible to win. 

3) The following prizes will be awarded to eligible participants: 

1. 1st Prize: 2 VIP tickets to a Champions League match in 2025, €500 for travel expenses, a football jersey signed by Kylian Mbappé, and a We. HEAR pro Outdoor Bluetooth Speaker by Kylian Mbappé. 

   2. 2nd Prize: A football jersey signed by Kylian Mbappé and a Loewe We. SEE oled 48. 

   3. 3rd to 5th Prize: A football jersey signed by Kylian Mbappé. 

   Prizes cannot be paid in cash or exchanged for other forms. 

4) Employees and family members of the Organiser, as well as employees and family members of cooperating partners involved in creating or processing the raffle, are excluded from participation. 

5) This campaign by the Organiser does not constitute a legal claim. Winners will be drawn randomly, and the decision is final. 

6) Participation through competition clubs or automated services is excluded. 

7) Abusive and/or unlawful behaviour by participants will result in immediate disqualification from the raffle. 

 

4. Processing, Drawing, and Announcement

1) Winners will be determined by random draw after the participation deadline and notified by 31 January 2025 at the latest via the email address provided during registration. Winners must contact the Organiser within 7 days after notification via email at [email protected], providing their contact details (name, delivery address) and proof of purchase (a copy or photo of the receipt) for verification. The Organiser will bear the standard shipping costs. Otherwise, the prize will be forfeited, and the Organiser reserves the right to redraw the prize. 

2) If the contact details provided are incorrect, the Organiser is not obligated to investigate correct details. Participants are responsible for any disadvantages arising from incorrect contact information. 

3) Prizes cannot be paid out in cash, exchanged, or transferred to other individuals. The Organiser reserves the right to offer an alternative prize of equal value in exceptional cases. Winners may waive their prize, in which case it will be redrawn. 

 

5. Liability and Disclaimers

1) The Organiser’s liability for damages is subject to the following limitations and exclusions, without prejudice to other statutory provisions of this Clause 5. 

 

2) The Organiser is fully liable for damages caused by intent or gross negligence. 

3) Furthermore, the Organiser is liable for slight negligence in the event of a breach of essential obligations, the breach of which jeopardises the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the campaign and on whose compliance the contractual partners regularly rely. In such cases, however, the Organiser’s liability is limited to foreseeable, contract-typical damages. The Organiser is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences. 

4) The above limitations of liability do not apply in cases of injury to life, body, or health, for defects after the assumption of guarantees for the quality of a product, or for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected. 

5) To the extent that the Organiser’s liability is excluded or limited, this also applies to the personal liability of its employees, representatives, and vicarious agents. 

6) The Organiser is not liable for potential legal violations by participants, including independent, unlawful contributions by participants in the context of the raffle, particularly for insults, false factual claims, or infringements of intellectual property rights. 

7) The Organiser is not liable for technical disruptions on its part or that of its service providers involved in the processing of the raffle. 

 

6. Data Protection Notices

Purpose of Processing 

The personal data collected in connection with this raffle will be processed by the Organiser for the purpose of conducting the raffle and potential prize fulfilment. 

Legality of Processing 

The basis for the collection and processing of personal data is Article 6(1)(a) of the EU General Data Protection Regulation (GDPR). Participation in the raffle is voluntary and can be revoked at any time (see below). 

Type of Personal Data 

We process data related to participation in the raffle. This includes the following at the time of participation: first name, last name, email address, and optionally, telephone number. After the raffle, we also process the data of the winner necessary for fulfilment and postal delivery (first name, last name, delivery address). 

Transfer of Personal Data 

The data will be passed on to the following companies for the purpose of processing and conducting the raffle: 

- Logistics service providers commissioned by the Organiser for the delivery of prizes. 

Retention of Personal Data 

Data required for prize fulfilment will be deleted by the Organiser after the purpose is achieved, i.e., after the raffle has ended and been processed and/or after the expiration of statutory retention periods. 

Revocation of Consent 

Consent to the processing of data may be revoked at any time with future effect. However, if the revocation occurs during the raffle period or before the final draw, the participant will be excluded from the raffle and prize distribution. Revocation may be made at any time. On request, in writing or text form to the following email or postal address, participants may ask the Organiser at any time to provide information about which personal data is stored, demand its correction, restriction, or deletion, and object to the processing of their data. In this case, your participation in the raffle can no longer be considered. Additionally, you have the right to lodge a complaint with a supervisory authority. 7. Changes and Applicable Law

1) The Organiser reserves the right to change these terms and conditions at any time with regard to the design. 

2) These terms and conditions are exclusively subject to the laws of the Federal Republic of Germany, excluding international private law.
